General damages to increase by 10% after 1 April 2013

The Court used an approval hearing to indicate that general damages in all tort claims will rise by 10% in accordance with the recommendations of Sir Rupert Jackson's report on costs in civil claims.

The judgment has been made several months in advance in an effort to provide 'simplicity and clarity’ and also ensures that all parties who are in, or contemplating litigation, have sufficient warning of the changes.

The increase will apply to the following where judgment is given after 1 April 2013:

  • general damages for pain, suffering and loss of amenity in personal injury;
  • nuisance;
  • defamation; and
  • all other torts which cause suffering, inconvenience or distress to individuals
