While the drafting and negotiation of a Break Clause in a Lease is often a key term when entering into a Lease, actually acting on the Clause should also be considered carefully.

If you are looking to break your lease it is essential that the Break Notice is served correctly or the right could be lost. On the otherhand, if your tenant is purporting to have served a Break Notice they may not have done so in accordance with the terms of the Lease which could mean that they are not entitled to vacate the premises and still have to fulfil their obligations, such as paying the rent.
